Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the NeatKiosk application (“NeatKiosk”, “the app”), published by WakeSys sarl, Luxembourg (“we”, “us”). By downloading, installing, or using NeatKiosk, you agree to these Terms. If you do not agree, do not use the app.

1. License

We grant you a free, limited, non-exclusive, non-transferable, revocable license to download and use NeatKiosk on Apple devices you own or control, for personal or business use, in accordance with these Terms and the Apple App Store Terms of Service. We retain all rights, title, and interest in the app.

2. Acceptable use

You agree not to: (a) use NeatKiosk for any unlawful purpose or to display unlawful content; (b) reverse-engineer, decompile, or disassemble the app except to the extent expressly permitted by applicable law; (c) resell, sublicense, or redistribute the app; or (d) attempt to defeat its security mechanisms on a device you do not own or control.

3. Your responsibility for displayed content

NeatKiosk is a tool that displays a website you choose. You, the operator of the device, are solely responsible for the website you configure and any content shown through the app, including ensuring it is lawful and that you provide end users any notices or consents that website or applicable law requires (for example cookie or privacy notices). We assume no responsibility for the content, availability, security, privacy practices, or legality of any third-party website displayed through NeatKiosk.

4. Third-party services

NeatKiosk relies on Apple operating-system features (such as WebKit, Guided Access, and, where applicable, Mobile Device Management). Your use of those features is subject to Apple's terms. We are not responsible for changes Apple makes to iOS or iPadOS that affect the app.

5. No warranty

NeatKiosk is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will meet your requirements, or that lockdown features cannot be circumvented. Device-level lockdown depends on Apple features (Guided Access / MDM Single App Mode) and their limitations.

6. Limitation of liability

To the maximum extent permitted by law, in no event will WakeSys sarl be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) NeatKiosk, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability relating to the app will not exceed fifty US dollars (USD $50). Because the app is provided free of charge, this allocation of risk is a basis of the bargain.

7. Apple App Store terms

NeatKiosk is distributed through the Apple App Store. The Apple Licensed Application End User License Agreement (Standard EULA) also applies to your use of the app. Apple is not a party to these Terms and is not responsible for the app or its content; however, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Any claim relating to the app should be directed to us, not Apple.

8. Changes to these Terms

We may update these Terms from time to time. The “Effective date” above shows the latest version, posted at this URL. Continued use of the app after changes take effect constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the Grand Duchy of Luxembourg, without regard to its conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have where you live. The courts of Luxembourg will have jurisdiction, subject to those mandatory rights.
